Welcome to Ultimate Carp Baits. These Terms and Conditions ("Terms") govern your use of our website https://ultimatecarpbaits.co.uk/ and the purchase of any products from us.

Please read these Terms carefully before placing an order. By accessing our website or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not place an order or use our website.

2. Order Process & Contract Formation

  • Eligibility: To place an order on our website, you must be at least 18 years old and legally capable of entering into binding contracts.

  • Placing an Order: When you place an order on https://ultimatecarpbaits.co.uk/, you are making an offer to purchase the products in your shopping basket.

  • Order Acknowledgement: Upon submitting your order, you will receive an automated email acknowledging receipt of your order. This email does not mean your order has been accepted.

  • Contract Acceptance: A binding contract between you and Ultimate Carp Baits is formed only when we send you an email confirming that the products have been dispatched ("Dispatch Confirmation").

  • Right to Decline Orders: We reserve the right to decline or cancel any order prior to dispatch for any reason, including product unavailability, errors in pricing or descriptions, or suspected fraudulent transactions.

3. Products, Bait Care & Storage

  • Product Descriptions: We make every effort to display the colours, descriptions, and packaging of our carp fishing baits accurately. However, natural ingredients, bait oils, and manufacturing batches may cause slight variations in appearance, texture, or scent.

  • Bait Care & Storage Disclaimer: All shelf-life baits, pop-ups, wafters, liquids, and additives must be stored in a cool, dry place out of direct sunlight in tightly sealed containers as instructed on the packaging. We accept no responsibility for spoilage resulting from improper storage after successful delivery (e.g., leaving products in hot vehicles or bivvies).

  • Product Usage: All products sold on https://ultimatecarpbaits.co.uk/ are strictly intended for use as angling bait and attractants. They are not fit for human consumption.

4. Prices and Payment

  • Pricing: All prices listed on our website are in British Pounds Sterling (GBP) and include UK VAT where applicable, but exclude delivery costs.

  • Delivery Charges: Delivery fees will be clearly displayed at checkout before you finalise your purchase.

  • Price Errors: Despite our best efforts, pricing errors may occur. If we discover an error in the price of items you ordered, we will notify you and give you the option to reconfirm the order at the correct price or cancel it. If we cannot reach you, the order will be treated as cancelled.

  • Payment Methods: We accept major credit/debit cards and secure payment providers as displayed at checkout. Payment must be made in full at the time of placing your order.

5. Shipping & Delivery

  • Delivery Area: We deliver to addresses within the United Kingdom.

  • Dispatch & Delivery Times: Estimated dispatch and delivery dates provided on our website or order confirmation are guidelines only and are not guaranteed.

  • Receipt of Delivery: It is your responsibility to ensure an accurate delivery address is provided at checkout and that someone is available to receive or collect the parcel.

  • Risk and Title: The risk of damage to or loss of products passes to you upon delivery to the address specified in your order. Ownership of the products passes to you once we receive payment in full, including delivery charges.

6. Returns, Cancellations & Refunds

Your rights to cancel and return orders are governed by the UK Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

Statutory Right to Cancel (14-Day Cooling-off Period)

  • You have the legal right to cancel your order within 14 days of delivery without giving a reason, subject to the exemptions below.

  • Notification Window: To exercise your right to cancel, you must inform us in writing by emailing admin@ultimatecarpbaits.co.uk with your order number and full name within 14 days of receiving your items.

  • Return Window: Once you have notified us of your cancellation, you have a further 14 days from the date of notification to send the goods back to us.

Exemptions to the Right to Cancel

Under Regulation 28 of the Consumer Contracts Regulations 2013, the right to cancel does not apply to:

  1. Opened or Unsealed Feed Products: Due to health protection, product safety, and bait integrity, we cannot accept returns on baits, pop-ups, wafters, liquids, or additives once the tub or container seal has been opened or unsealed after delivery.

  2. Custom / Bespoke Goods: Custom-rolled baits, bespoke size orders, or custom ingredient blends made specifically to your specifications.

Returning Non-Faulty Goods

  • Returned items must be unused, unsealed, in their original packaging, and in resalable condition.

  • Return Shipping Costs: You are responsible for paying all return shipping costs for change-of-mind returns. Return shipping fees are non-refundable.

  • We strongly recommend using a tracked postal service, as we cannot issue a refund for items lost or damaged in return transit.

Damaged, Faulty, or Incorrect Goods

If your order arrives damaged, defective, or incorrect, you are protected under the Consumer Rights Act 2015:

  • Reporting Window: Please report transit damage or defects to us within 48 hours of delivery by emailing admin@ultimatecarpbaits.co.uk.

  • Required Evidence: To process a replacement or refund, we require clear photographic evidence showing:

    1. The outer shipping box / transit packaging.

    2. The shipping label showing your name and address.

    3. The specific damage or defect to the product / inner seal.

  • Resolution: Once verified, we will arrange a replacement or full refund (including standard delivery charges) at no cost to you. If a return of the damaged item is required, we will provide a prepaid return label.

7. Limitation of Liability

  • Nothing in these Terms limits or excludes our liability for:

    • Death or personal injury caused by our negligence;

    • Fraud or fraudulent misrepresentation;

    • Any breach of your statutory rights under the UK Consumer Rights Act 2015.

  • Subject to the above, Ultimate Carp Baits shall not be liable for any indirect or consequential loss, loss of profits, loss of business, or wasted expenditure.

  • Our total aggregate liability to you in connection with any order shall not exceed the total price paid by you for the products ordered.

8. Intellectual Property

All content on https://ultimatecarpbaits.co.uk/, including text, product images, graphics, logos, and branding, is the property of Ultimate Carp Baits and is protected by UK and international copyright laws. You may not reproduce, distribute, or modify any content without our prior written consent.

9. Reviews & User Submissions

If you post reviews, fish catch photos, or testimonials on our website or social media channels referencing Ultimate Carp Baits, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display that content across our marketing channels.

10. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. You and Ultimate Carp Baits agree that the courts of England and Wales shall have exclusive jurisdiction.

11. Changes to Terms

We reserve the right to amend these Terms at any time. Any updates will be posted on this page with an updated "Last Updated" date. The Terms in effect at the time you place an order will apply to that purchase.
